Emergency Situations

Emergencies happen, and consent by you is not always fast enough.

An example of such an emergency could be the child being a danger to him or herself or others and in need of urgent medical care.

  • Texas law allows a healthcare provider to treat a child in DFPS conservatorship (care) in an emergency without consent by DFPS or the authorized medical consenter. This law applies to a youth also.
  • The healthcare provider makes the decision about whether they can treat without consent.

In an emergency situation, the child’s caregiver or DFPS caseworker should
immediately take the child to an emergency room or healthcare provider.
