Confidentiality (PATS 6747)

The items below are revised to explain the type of information that is considered confidential and the circumstances under which confidential information may be released. Confidential information is information that is not intended for release to the public.

The revisions reflect changes made to the rules on confidentiality, as published in the Texas Administrative Code, Chapter 745, Subchapter K, Division 3, Confidentiality. The changes were passed during the 83rd Legislature.

New Exemptions From Regulation (PATS 6663)

The items below are revised to add information on two new exemptions. Emergency shelters that serve minors are now exempt from regulation by Licensing, as are emergency shelters that serve the victims of human trafficking. Both exemptions were passed during the 83rd Legislative Session.

Other revisions include clarifying the difference between an operation that is not subject to regulation and an operation that is exempt from regulation, updating information on new exemption forms and on the form letters used to communicate with providers, and adding a section on illegal operations.

  •   includes revised directions for documenting and storing photos and video.
