Appendix 2813-D: No Alleged Perpetrator Named in Intake Allegation (Case Scenario)

CPS September 2002

Scenario: In this scenario, Sue is the alleged victim, Joe is an eight-year-old sibling, Jan is a 15-year-old sibling, Ann is the mother, and Jack is the father.

The reporter alleged Sue had been neglectfully supervised but did not know who might have been responsible. The intake worker felt that the neglect of Sue met statutory definitions and could have reasonably resulted from an act or failure to act by a parent or sibling. As a result, the intake worker entered an allegation that named Sue as the alleged victim but did not include the name of an alleged perpetrator. 

In this instance, the investigation worker could finalize the allegations as indicated in the following table (all possible outcomes may not be represented).

There was a preponderance of evidence that Ann neglectfully supervised Sue,

Add Ann's name to the allegation and give it a disposition of "reason to believe."

There was a preponderance of the evidence that Sue had been neglectfully supervised, and

there was some but not a preponderance of evidence that Jack was the perpetrator,

Give the allegation the disposition of "reason to believe" but do not add the name of an alleged perpetrator, and

add an allegation that names Jack as the alleged perpetrator of neglectful supervision, and give the allegation the disposition of "unable to determine."

Jack NSUP Sue = UTD

It was reasonable to conclude that Sue was not neglectfully supervised,

Give the allegation the disposition of "ruled out" without adding the name of an alleged perpetrator.

It was reasonable to conclude that the Jan failed to baby sit the alleged victim as Jan had agreed to do, but the situation did not meet the statutory definition of neglectful supervision,

Add Jan's name as the alleged perpetrator to the allegation and give it the disposition of "ruled out."
